Two regulators, deliberately aligned
The common framing is a contest: bottled is safer, or tap is safer. The regulatory structure is not a contest.
EPA received oversight of public drinking water under the 1974 Safe Drinking Water Act. FDA then “took responsibility, under the FD&C Act, for ensuring that the quality standards for bottled water are compatible with EPA standards for public drinking water.”
The mechanism matters more than the split:
Each time the EPA establishes a standard for a contaminant, the FDA either adopts it for bottled water or finds that the standard isn’t necessary for bottled water.
So FDA is not writing an independent rulebook. It is tracking EPA’s, with discretion to skip a standard where the format makes it irrelevant.
Where they differ, and which way
The clearest example runs in bottled water’s favour, and for a reason that explains the whole structure.
FDA: “because lead can leach from pipes as water travels from water utilities to home faucets, the EPA set its limit for lead in public drinking water at 15 parts per billion. For bottled water, for which lead pipes aren’t used, the lead limit is set at 5 ppb.”
The tap limit accounts for the journey through plumbing. A bottle has no journey, so the limit can be tighter.
One caveat on that quote. FDA’s page states EPA’s lead figure as 15 ppb. EPA’s Lead and Copper Rule Improvements lowered the lead action level to 10 µg/L, so the tap figure on FDA’s page is the superseded one. The 5 ppb bottled limit is the point being made and is unaffected — but if you are comparing the two numbers, compare against 10.
The difference that actually affects you
Not a contaminant limit. An information right.
EPA requires community water systems to deliver a Consumer Confidence Report to customers each year by July 1, listing the source, the regulated contaminants detected, and the health effects of anything detected in violation.
FDA’s bottled water requirements are about production: Current Good Manufacturing Practice regulations, water “sampled, analyzed, and found to be safe and sanitary”, plant and equipment design, record keeping, and registration as a food facility under FSMA preventive controls.
Those are real obligations, and they are obligations to manufacture properly — not to tell you annually what was in what you drank.
Switching to bottled water does not remove a contaminant. It removes the report. You trade a supply you have documented figures for against a supply you do not.
Why it tastes different
Usually the disinfectant, and the reason is in the same FDA page.
Bottlers “typically use ozone gas, an antimicrobial agent, instead of chlorine to disinfect the water. Chlorine can add residual taste and odor.”
That is the whole taste gap for most people, and it is addressable at the tap for a fraction of the cost.

Worth noting the trade: ozone leaves no residual. Chlorine’s residual is what keeps protecting water through the distribution system and inside your pipes. A sealed bottle does not need that; an opened one no longer has it.

Choose bottled water if
- You are under a boil-water notice or in an emergency, where it is the correct answer and nothing here argues otherwise.
- You have no treated supply available, such as while travelling.
- A specific short-term need exists, such as formula preparation while a lead filter is being fitted.
Choose a filter at the tap if
- Your report names a contaminant and a certified claim exists for it.
- The problem is taste or odour, which is usually the disinfectant.
- The alternative is buying bottled water indefinitely for a problem that a single fitted claim resolves.
Choose to do neither if
- Your report shows nothing above a limit and you are content with the taste. Both purchases solve a problem you do not have.
Mistakes that cost the most money
Treating bottled as a category upgrade. FDA tracks EPA’s standards rather than exceeding them by design, and adopts or skips each one.
Assuming a bottle comes with a quality report. It does not. The annual report obligation sits on community water systems.
Switching to bottled for lead. It avoids the contaminant but leaves the plumbing untouched, costs more per litre indefinitely, and only covers the water you buy — not what you cook with or brush your teeth in.
Reading “purified” as “contaminant-free”. It describes processing — distillation, reverse osmosis or another suitable process — not a result.
Comparing FDA’s 15 ppb against EPA’s current figure. That FDA page predates the LCRI, which lowered the action level to 10 µg/L.
Buying bottled indefinitely for a taste problem. The taste gap is largely ozone versus chlorine, and a carbon filter with the right claim closes it once.
Three situations, and what changes
You dislike the taste of city water. This is the most common reason people switch, and it is the one a filter resolves most cheaply. FDA’s ozone-versus- chlorine note explains the difference you are tasting.
Your report shows a contaminant above a limit. Bottled water is a reasonable bridge while you fit treatment, and a poor destination. A certified claim addresses the contaminant at the tap and keeps your annual report.
You rent and receive no report. Bottled water feels like the cautious choice, but you are choosing between two undocumented supplies. Look up your system’s published report first — the water is the same as your landlord’s.
The objections worth answering
“Bottled water is tested more often.” FDA requires sampling and analysis under CGMP, and EPA requires monitoring plus an annual public report. The difference in what reaches you favours tap, because only one of those two regimes is obliged to tell you the result.
“My bottled brand publishes its own report.” Some do, voluntarily, and that is worth reading. It is not the same as a federal requirement, and a voluntary report can stop.
“Tap water has chlorine in it.” It does, deliberately, capped at 4.0 mg/L as a residual disinfectant. EPA’s concern behind that limit is controlling byproducts rather than the disinfectant itself, and the residual is what protects the water inside your own plumbing.
Who this is for
Households deciding whether to keep buying bottled water, and anyone who assumed the bottle was a regulatory upgrade on the tap rather than a differently regulated version of the same thing.
